1. Acceptance of Terms
By accessing our website, submitting a charter request, signing a charter agreement, or using any of our private aviation services (“Services”), you (“Client,” “Passenger,” or “User”) agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree, you may not access or use our Services.
2. Nature of Services
SkyView Charters LLC acts as a private air charter broker and/or aircraft operator, arranging private jet transportation for clients.
Unless explicitly stated otherwise in a written agreement, SkyView Charter does not own or operate aircraft but arranges flights through FAA-certified air carriers that hold Part 135 (or international equivalent) operating authority.
All flights are operated by properly licensed, insured, and compliant air carriers.
3. Eligibility
To charter an aircraft or use our Services, you must:
Be at least 18 years of age;
Have the legal capacity to enter into binding contracts;
Provide accurate and complete booking information; and
Not use our Services for unlawful purposes or to transport prohibited goods.
4. Bookings and Payment
4.1 Quotes and Availability
All flight quotes are estimates based on aircraft availability, routing, fuel pricing, airport fees, and other variables at the time of quotation. Quotes are not guaranteed until confirmed by SkyView Charters in writing.
4.2 Confirmation
A booking is confirmed once SkyView Charters receives a signed Charter Agreement and full payment (or required deposit). Upon confirmation, SkyView Charters will issue a written itinerary.
4.3 Payment Terms
Full payment is typically due at the time of booking unless otherwise stated.
Accepted forms of payment include wire transfer, credit/debit card, or approved digital payment methods.
All payments are non-refundable, except as otherwise stated in Section 6 or in your signed Charter Agreement.
4.4 Taxes and Fees
Quoted prices exclude applicable taxes, airport fees, crew wait time, de-icing, catering, and other variable charges unless otherwise stated. Any additional costs incurred during or after the flight will be billed to the Client.
5. Client Responsibilities
Clients and passengers must:
Arrive at the departure airport or FBO (Fixed Base Operator) at least 20–30 minutes prior to scheduled departure;
Provide accurate passenger information (including full legal names and identification details);
Comply with all TSA, FAA, and international aviation regulations;
Follow crew instructions at all times; and
Refrain from carrying hazardous materials, illegal substances, or firearms without authorization.
SkyView Charters reserves the right to deny boarding or terminate a flight if a passenger engages in unsafe, disruptive, or unlawful conduct.
6. Cancellations and Changes
6.1 Client Cancellations
Once a charter is confirmed, all payments are non-refundable.
If a Client cancels after confirmation, the full charter price will be forfeited.
In certain cases, SkyView Charters may, at its sole discretion, credit a portion of the payment toward a future flight.
6.2 Operator Cancellations or Delays
If the operating carrier cancels or delays a flight due to mechanical issues, weather, safety concerns, or circumstances beyond control, SkyView Charters will make reasonable efforts to re-accommodate the Client on another aircraft or reschedule the flight.
If re-accommodation is not possible, SkyView Charters may issue a partial or full refund, depending on costs already incurred.
SkyView Charters shall not be liable for incidental expenses, including hotel stays, missed connections, or lost business opportunities.
7. Flight Operations and Safety
The Pilot in Command has complete authority over all flight operations, including route, altitude, speed, and passenger behavior.
The pilot may refuse to commence or may terminate a flight if safety is at risk or if weather, mechanical, or regulatory conditions prevent operation.
Smoking, vaping, or open flames are not permitted onboard unless expressly authorized.
Passengers must comply with all weight, baggage, and manifest requirements.
8. Liability Limitation
To the maximum extent permitted by law:
SkyView Charters is not liable for any injury, loss, damage, delay, or expense resulting from acts beyond our control, including weather, mechanical failure, air traffic control decisions, labor disputes, or acts of terrorism;
SkyView Charters does not guarantee punctuality or uninterrupted service;
SkyView Charters’ liability, if any, shall be strictly limited to the amount paid for the specific charter in question.
You agree to indemnify and hold harmless SkyView Charters, its employees, agents, affiliates, and representatives from any claims or damages arising from your use of the Services, breach of these Terms, or violation of law.
9. Insurance
All flights arranged by SkyView Charters are operated by carriers maintaining insurance coverage meeting or exceeding FAA and DOT minimum requirements.
Clients may obtain additional personal or trip-specific insurance at their own discretion.
SkyView Charters does not provide travel insurance, luggage insurance, or cancellation protection.
10. Passenger Identification and Security
All passengers must present valid government-issued identification prior to boarding.
For international flights, valid passports (and visas where applicable) are required.
Failure to provide appropriate documentation may result in denied boarding without refund.
11. Aircraft Substitution
SkyView Charters reserves the right to substitute an aircraft of equal or greater quality and capacity if the originally contracted aircraft becomes unavailable due to maintenance, scheduling, or operational issues.
12. Force Majeure
SkyView Charters shall not be held liable for any failure or delay in performance caused by events beyond reasonable control, including but not limited to natural disasters, war, terrorism, labor strikes, weather, mechanical failure, or governmental restrictions.
13. Intellectual Property
All materials on our website—including text, images, logos, videos, and trademarks—are owned or licensed by SkyView Charters.
You may not copy, reproduce, or distribute any materials without our written permission.
14. Privacy
Your use of our website and Services is subject to our Privacy Policy, which details how we collect and use your information.
By using our Services, you consent to those data practices.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Hillsborough County.
You waive any objection to such jurisdiction or venue.
16. Modifications
SkyView Charter may update or modify these Terms of Service at any time without prior notice.
The most current version will always be available on our website.
Continued use of our Services after any updates constitutes your acceptance of the revised Terms.
